In a Jan. 26, 2026 episode of The Daily Show, Jon Stewart criticized the Trump administration’s account of Alex Pretti’s fatal shooting in Minneapolis, focusing on publicly available video and the administration’s arguments about guns and the Second Amendment. What Stewart’s segment covered
The official episode upload is titled “Jon on Alex Pretti’s Killing, DHS vs. Video Evidence & MAGA’s Gun Rights Surrender.” Its description says Stewart challenged administration statements in light of video evidence and discussed the Second Amendment. The episode was published Jan. 26, 2026; a third-party Ears Edition transcript lists Jan. 27 as the episode date. The official episode video and Paramount+ episode listing are viewing references.
Stewart’s argument was that the public footage conflicted with the administration’s portrayal of Pretti and raised questions about how gun rights were being applied. The transcript records him saying, “Videos of the shooting of Alex Pretti have contradicted the government’s account of what happened,” and, “All he has in his hand is a cell phone, not a gun.” These are brief excerpts from his satirical commentary, not conclusions by investigators. The third-party transcript can help locate the passages; the official video is the primary reference for the segment.
What AP reported the footage appeared to show
In reporting published Jan. 26, 2026, the Associated Press compared officials’ descriptions with publicly available bystander video. AP reported that footage showed Pretti with a phone and that no publicly released footage appeared to show him brandishing a gun immediately before or during the confrontation. AP said the video undermined parts of the administration’s account, including descriptions of how Pretti approached officers and whether the shooting was defensive.

That assessment is limited to footage available publicly at the time and AP’s review, including input from use-of-force experts. Video can establish visible actions and timing, but it does not by itself settle intent, legal justification, or every fact investigators may have had. AP’s reporting is not a final adjudication of the shooting.
What was known about investigations and access
AP’s Jan. 26 report described Pretti as a 37-year-old ICU nurse killed during an encounter with federal immigration officers in Minneapolis. At that point, the White House said DHS and the FBI were investigating and that Customs and Border Protection was conducting an internal review. FBI Director Kash Patel described the bureau’s role as assisting with physical evidence.

There was also a dispute over who could examine the scene. Minnesota’s Bureau of Criminal Apprehension said federal officers had blocked its investigators from access despite a signed warrant. AP reported that a federal judge ordered evidence preserved against destruction or alteration. The identities of the agents, the evidence held by investigators, and the precise scope of the reviews were not established in AP’s Jan. 26 account. Those details describe the situation as reported that day, not necessarily later developments.

These are different kinds of claims. Stewart interprets events for a television audience; AP reports on official statements, available video, and investigative access. Neither the segment nor the reporting snapshot should be mistaken for a completed official determination.
