George R.R. Martin’s Latest Lawsuit Update: What It Says About *The Winds of Winter*

The lawsuit mentions alleged AI-generated versions of Martin’s planned novels, but the latest update does not confirm that The Winds of Winter is finished or scheduled.

George R.R. Martin’s lawsuit against OpenAI and Microsoft does not reveal that The Winds of Winter is finished or has a release date. The latest located update from the Authors Guild says both sides filed motions for summary judgment in September 2026. The book appears in the case because Martin’s 2023 complaint alleges that a ChatGPT user generated versions of it—not because Martin announced a completed manuscript.

What did the lawsuit update say?

According to the Authors Guild’s September 5, 2026 update, Martin and other authors filed a motion for summary judgment on September 4. OpenAI and Microsoft filed their own motions. The authors are asking the court to rule against the defendants’ fair-use defense. These are competing requests for a decision, not a decision by the judge.

The Guild says the case began in September 2023 and was later consolidated with other copyright cases, including claims brought by news organizations, in a multidistrict proceeding in the Southern District of New York before Judge Sidney H. Stein. A summary-judgment motion asks a judge to decide issues based on the record without a full trial. If material facts remain disputed, the case may proceed to trial; the Guild did not say a trial is certain.

The September 5 update listed opposition briefs as due in early October and reply briefs in early November. It is the latest located update used here; whether those briefs were filed or the court has since acted is not established by that update.

Why is *The Winds of Winter* mentioned?

Martin’s December 2023 complaint says that in July 2023 a user prompted ChatGPT to generate versions of The Winds of Winter and A Dream of Spring, which it describes as the planned final books in A Song of Ice and Fire. The same complaint says Martin was then writing them. That is a description in a legal pleading from 2023, not a completion announcement. The allegation and its context appear in the complaint.

The complaint also alleges that Martin owned or beneficially owned registered copyrights in 15 works of fiction. That number is the plaintiffs’ allegation, not a count verified by a court. Likewise, the complaint’s account of an AI-generated output does not establish that the text was Martin’s writing, that a particular model memorized his book, or that a judge has found infringement.

Is *The Winds of Winter* finished or scheduled for release?

The latest official Martin blog posts located do not give the novel a completion status or release date. His August 3, 2026 post discusses his absence and personal circumstances; his September 3 post announces the London transfer of a stage production. Neither announces the book. A May 2026 report recaps earlier statements by Martin about pages remaining, but it is historical reporting, not a new lawsuit disclosure or a publisher announcement. It cannot establish when the novel will be finished or released: the May 2026 progress report.

The plaintiffs’ brief used the phrase “OpenAI’s GPT models pose an existential threat to those who write and publish books,” quoted in the Guild’s September 5 update. That is advocacy by a party, not the judge’s conclusion.

What should readers take from the update?

The case concerns copyright claims against OpenAI and Microsoft, and the planned final novels are mentioned in the plaintiffs’ account of alleged ChatGPT output. Nothing in the latest located litigation update substitutes for a statement from Martin or his publisher about the manuscript or a publication date. Readers looking for a published book in the series can turn to A Dance with Dragons; it is not the unpublished sixth novel, The Winds of Winter.
