What the tribunal decided
The tribunal allowed Lineker’s appeal on preliminary issues. It found that the services at issue were supplied under direct contracts between Lineker and the BBC and BT Sport, and considered the partnership arrangement and intermediary legislation in reaching its decision. The ruling turned on the facts and contractual arrangements before the tribunal.
Tribunal Judge John Brooks was reported as stating: “As a matter of law, when Mr Lineker signed the 2013 BBC Contract, the 2015 BBC Contract and the BT Sport Contract for the provision of his services, he did so as principal thereby contracting directly with the BBC and BT Sport.” The decision is available as [2023] UKFTT 00340.
