Court Documents in Laura Owens v. Clayton Echard: What the Record Says

The court documents in Laura Owens v. Clayton Echard trace the paternity petition, the Superior Court’s findings and an appellate decision affirming attorney fees and costs.

The court record in Laura Owens v. Clayton Echard, Maricopa County Superior Court case FC2023-052114, documents a disputed paternity petition, court-described Ravgen test results, a June 2024 evidentiary hearing, and a later attorney-fee judgment that Arizona’s Court of Appeals affirmed. The appeal addressed the fee award—not a new trial of the underlying factual dispute.

Which court documents are at the center of the case?

The Superior Court’s June 17, 2024 under-advisement ruling addresses the paternity petition and the trial-court proceedings. The Arizona Court of Appeals’ March 28, 2025 memorandum decision reviews the later attorney-fee judgment. The appellate court identifies Owens as petitioner and Echard as respondent in case FC2023-052114. Read the appellate decision.

The two documents serve different purposes: the Superior Court ruling recounts the case record and makes trial-court findings; the appellate decision explains why the fee judgment was affirmed. The Court of Appeals decision is unpublished, says it does not create precedent, and generally may not be cited except as Arizona rules allow.

What does the Superior Court ruling say happened?

The ruling gives May 20, 2023, as the petition filing date. The appellate decision’s introductory procedural summary instead says Owens filed in August 2023. The dates conflict in the available documents; the Superior Court ruling supplies the more detailed procedural history, but the discrepancy should not be silently resolved.

Testing and the reported results

The Superior Court ruling says the parties entered a Rule 69 agreement at an Early Resolution Conference on September 28, 2023, to comply with a Ravgen DNA test on October 2. According to the ruling, results reported on October 6 indicated “little to no fetal DNA.” It says a second test on December 6 produced the same reported result, while a third test’s results were lost in transit. The ruling also recounts that Echard filed an affidavit of non-paternity in December.

Those are the ruling’s descriptions of reported testing and the record. They should not be recast as a test result that independently established paternity or non-paternity.

Dismissal request and evidentiary hearing

The ruling says Owens sought dismissal after stating she was no longer pregnant. The court denied the motion because fees, costs, and sanctions remained at issue, then held an evidentiary hearing on June 10, 2024, addressing paternity, fees, costs, and sanctions. The written ruling is dated June 17, 2024.

What did the trial court find?

The Superior Court concluded it could not establish paternity of a non-confirmed pregnancy. Its ruling discusses claims, testimony, discovery, and conduct during the litigation. The appellate decision summarizes the trial court’s finding that Owens filed the case “without basis or merit” and that her testimony about pregnancy viability was false. These are court findings and descriptions—not neutral statements about a person’s motives or character.

What did the appeal decide about fees?

The Court of Appeals reports that the Superior Court awarded Echard $149,219.76 in attorney fees and costs in August 2024. On March 28, 2025, the appellate court affirmed that judgment. It said the award rested on Arizona statutes, including A.R.S. §§ 25-324 and 25-415, rather than Arizona Rule of Family Law Procedure 26. Because the trial court relied on the statutes, the appellate court did not decide whether Rule 26 sanctions would have been proper.

The appellate court rejected arguments about statutory authority and the trial judge’s alleged bias or independent investigation. Its conclusion was: “For the foregoing reasons, we affirm the trial court’s judgment.” — Judge Vásquez, Arizona Court of Appeals, Division Two, March 28, 2025.

Arizona Superior Court records

Arizona eAccess provides online access to eligible Superior Court civil and criminal records filed on or after July 1, 2010. Some cases and documents are unavailable because they are sealed, confidential, or otherwise restricted. Available documents may be purchased individually or accessed through a monthly subscription.
