Maribel Guardia acudió el 7 de octubre de 2026 a la Fiscalía General de Justicia de la Ciudad de México para ratificar una denuncia relacionada con presuntos delitos de homicidio y daños contra la salud en el caso de Julián Figueroa. Su abogado, Alonso Beceiro, dijo que la visita daba seguimiento a la denuncia. No se ha informado de una determinación oficial sobre responsabilidad penal: una denuncia no prueba que se haya cometido un delito.

Guardia se presentó en la Fiscalía capitalina para ratificar una denuncia reportada en septiembre. UnoTV informó que Beceiro confirmó la ratificación; Infobae había reportado el día anterior que Guardia planeaba acudir para dar seguimiento a la carpeta. UnoTV y Infobae México cubrieron la comparecencia y el seguimiento.
La denuncia se vincula, según declaraciones atribuidas al abogado de Guardia, con lo que Imelda Tuñón había contado sobre conseguir medicamentos para Julián. El abogado dijo que buscaban que las autoridades investigaran ese relato. Esa es la explicación de la representación legal, no una conclusión de la Fiscalía. El Financiero informó sobre la denuncia en septiembre.

Infobae reprodujo una declaración de Tuñón en el pódcast Mesa Cero: “Le mentí todo el tiempo a la psiquiatra. Julián tenía muchos problemas para dormir, entonces yo iba y le decía los síntomas. Y me daba las pastillas, o sea, así. Entonces, se las tomaba Julián, tenía mucha ansiedad”.

Es un relato atribuido a Tuñón, citado en la cobertura; por sí solo no establece la causa de muerte de Julián ni la responsabilidad de ninguna persona. La cobertura también consignó que la causa inicialmente informada de su muerte, en abril de 2023, fue un infarto agudo al miocardio. Infobae México publicó el contexto de esas declaraciones.
La denuncia se refiere a presuntos delitos. A la fecha de los reportes citados, no se había informado de una resolución de la Fiscalía sobre el fondo ni de una determinación de responsabilidad penal. Publimetro México explicó la diferencia entre presentar una denuncia y acreditar responsabilidad.

Cómo se distingue de la disputa familiar de 2025
Este episodio no debe confundirse con la denuncia que Guardia presentó en enero de 2025 por presunta violencia familiar y con sus preocupaciones sobre el cuidado de su nieto. La cobertura de entonces recogió versiones distintas de Guardia y Tuñón acerca de la intervención de las autoridades y la situación del menor. EL PAÍS México informó sobre el inicio de esa disputa; N+ publicó la versión de Tuñón.
El Financiero reportó el 1 de febrero de 2025 que la estancia temporal del menor con Guardia se había extendido por al menos 90 días durante una investigación complementaria. Ese dato describe una medida temporal informada entonces, no el arreglo de custodia vigente en octubre de 2026. El Financiero detalló esa etapa.
