In 2019, she said she had come close to leaving amid what she viewed as an unfair share of parenting work. In May 2022, she revealed that they had been separated since February 2021. Later coverage addressed their co-parenting, but public reports do not establish private custody arrangements or the couple’s current legal status.
Before the separation: Philipps described a near-divorce
In a 2019 interview discussed by ABC News, Philipps said she had been close to leaving the marriage because she felt the parenting responsibilities were not divided fairly. ABC reported that she was, at one point, “fully out the door” in the context of caring for their daughters.
As ABC quoted her: “My thinking was that if I leave, at least then maybe I’d get two days off a week.” She was describing her perspective at the time, not establishing an independent account of how the couple divided their work. ABC reported that Silverstein stepped up after she raised the issue, helping avert divorce then. The account is part of the relationship story Philipps had shared around her 2018 memoir, This Will Only Hurt a Little. ABC News’ 2019 report covers her comments.
February 2021 separation, announced publicly in May 2022
On her podcast, Busy Philipps Is Doing Her Best, Philipps said that she and Silverstein had been separated since February 2021. The separation date and the date she told the public are different: she made the announcement in May 2022, more than a year later.

UPI quoted her telling co-host Caissie St. Onge: “It’s been a really long time that Marc and I have been separated, and our kids know, our families know, our friends know,” Philipps told Caissie St. Onge, co-host of her podcast, Busy Philipps Is Doing Her Best.
Philipps said she and Silverstein had discussed how to handle the news and felt unable to make a conventional public statement. She characterized the decision as personal and specific to their family. At the time, E! News reported that they had married in June 2007, had two children, and had been married for 15 years. Those are contemporaneous details, not current ages or a statement about legal proceedings. Read The Independent’s report, E! News’ coverage, and UPI’s account of her announcement.

After the announcement: comments about co-parenting
A 2024 Entertainment Tonight report covered Philipps’s comments about co-parenting with Silverstein and the importance of being able to communicate. It offers a later public glimpse of how she discussed their parenting relationship; it does not establish private custody terms. Entertainment Tonight’s 2024 report focuses on those comments.

- 2019: Philipps spoke publicly about nearing divorce and feeling that parenting work was unfairly shared; ABC reported that Silverstein’s response helped avert divorce at that point.
- February 2021: The separation began, according to the date Philipps gave in her later podcast announcement.
- May 2022: She made the separation public and said their children, family, and friends already knew.
- 2024: Coverage addressed co-parenting and communication, without detailing custody arrangements.
“Brutal” should not be treated as Philipps’s description of the separation: the cited reports do not establish that wording as her own or as a neutral account of their private experience. The available coverage supports a timeline of her public comments, not a complete account from both former partners or confirmation of their current legal status.
