Apple Cider Vinegar is inspired by Belle Gibson’s real story, but it is a fictionalized drama—not a documentary. The Federal Court of Australia found that Gibson’s claims about having brain cancer and rejecting conventional treatment were misleading or deceptive in trade or commerce. It also found that a series of charity claims did not match what was donated. Those were civil consumer-law findings, not a criminal conviction for fraud.
What the Federal Court found Belle Gibson had misrepresented
In 2017, the Federal Court of Australia declared that representations Gibson made from about July 2013 were misleading or deceptive in trade or commerce. They included claims that she had been diagnosed with brain cancer in 2009, had been given four months to live, and had rejected conventional treatment in favor of trying to heal naturally. The court’s orders restrained Gibson and her company from making specified versions of those representations in connection with health and wellbeing advice. The court described the representation that Gibson had been living with brain cancer as “obviously false.” That is a judicial phrase from the court’s reasons, not a criminal verdict. The legal issue was whether the relevant representations were misleading or deceptive in trade or commerce.
What the court found about the charity claims
The court examined representations connected with The Whole Pantry app, company earnings, launch tickets, a particular week of app sales and a Mother’s Day event. It found that what was represented as donated did not match what was donated, or when it was donated. The judgment records these figures:

Was Belle Gibson convicted of fraud or sent to jail?
No criminal conviction or jail sentence is established by the sources cited here. The case described above was civil consumer-law enforcement. Consumer Affairs Victoria reported that the Federal Court ordered Gibson to pay a A$410,000 penalty and A$30,000 in costs. The regulator reported the penalty outcome on 28 September 2017; costs were a distinct amount, not part of the penalty. Consumer Affairs Victoria’s 2017 account of the penalty.
In its report published 12 February 2025, ABC stated that Gibson had not been prosecuted or convicted of a crime. ABC also recounted that she appeared in court in 2019 saying she could not repay the fines, and that the Sheriff’s Office conducted searches in 2020 and 2021. What happened in the real story?
ABC reports that Gibson admitted in April 2015 that she had never had cancer. Her rise through social media, publishing deal and post-admission interview on 60 Minutes are part of the real-world outline behind the drama. For the legally precise account, however, the Federal Court judgment is the primary source: it sets out the representations the court found misleading or deceptive and the orders made in response.
There is an important distinction between that finding and a claim about Gibson’s private state of mind. The court found the representations had no rational or reasonable basis, but ANU’s summary says Justice Debra Mortimer was not persuaded that Gibson lacked a genuine belief in her claim and that the court considered possible delusion when assessing the evidence. What Apple Cider Vinegar changes or fictionalizes
Netflix calls the series a “true-ish story, based on a lie” and describes it as a fictionalized drama inspired by Gibson and the nonfiction book The Woman Who Fooled the World. Netflix says Gibson was not involved in production; some characters were inspired by real people, others combine several people, and some were created for the show. ABC likewise distinguishes the real outline from the connective story written for television. It describes Milla as an amalgamation of real-world wellness influencers and believers, while Lucy is fictional. The show’s scenes, dialogue and character relationships should therefore be treated as dramatic interpretation unless independently supported by the court record or reliable reporting—not as proof of what happened in real life.
