Did Ben Affleck and J.Lo’s Prenup Really Have a Sexual Stipulation?

The four-times-weekly sex clause attributed to Ben Affleck and Jennifer Lopez’s prenup has not been verified; a separate 2003 report concerned alleged infidelity language.

The widely repeated claim that Ben Affleck and Jennifer Lopez’s prenuptial agreement required sex four times a week is unverified. A separate 2003 report described an alleged no-cheating clause, but neither report establishes what the couple’s private agreement actually said.

What was the alleged sexual stipulation?

In 2022, reports revived a claim that a prenup between Jennifer Lopez and Ben Affleck required the couple to have sex four times each week. El Universo and EL PAÍS presented the claim as something reported by other media, not as a term verified from the agreement itself. The four-times-weekly figure is therefore an allegation, not confirmed contract language. El Universo’s account also says Affleck denied the claim in a 2003 Vanity Fair interview.

According to El Universo’s later account of that interview, Affleck said: “You can’t legislate behavior. You have to believe in the person and believe that you can meet the challenges that you face.” He was also quoted as saying, “It would be nice if you could have ‘the rules,’ but you just can’t write it.” These quotations are reported secondhand here; the original interview and the private agreement are not reproduced in the available accounts. Was that the same as the reported no-cheating clause?

No. In September 2003, The Guardian reported that Lopez had insisted on a “no-cheating” term in a prenup being discussed ahead of the couple’s planned wedding. That was a contemporary report about fidelity, not a report of a sexual-frequency requirement, and it did not publish the agreement. The Guardian’s 2003 report

The two claims arose in different reporting contexts: one concerned alleged infidelity language in 2003, while the four-times-weekly claim circulated widely in 2022 and was later attributed to earlier media reports. Neither should be treated as proof of the other, or as confirmation of the document’s terms.

What can be established about whether they had a prenup?

Public accounts do not establish reliable, confirmed terms of an Affleck-Lopez agreement. Reporting in 2024 was itself qualified and inconsistent: a law-firm blog characterized the couple as not having a prenup, while another article attributed that claim to a source and cautioned that silence in a divorce filing could not prove whether a private premarital agreement existed. What did legal commentators say about a sexual-frequency clause?

The legal discussion in the cited coverage concerns Spain, not California law or a court ruling about Affleck and Lopez. EL PAÍS quoted Spanish legal professionals who viewed a sexual-frequency requirement as potentially conflicting with liberty, dignity, or personal intimacy; it also described a differing view that voluntarily assumed agreements might be treated differently. Why the story is hard to verify

  • The strongest contemporaneous account here, The Guardian’s 2003 report, describes an alleged fidelity term but does not reproduce a contract.
