He said he was “absolutely horrified” by his behavior and had been in the throes of a blackout. Prosecutors later charged him with misdemeanor public intoxication and cocaine possession; a judge approved diversion in June, but the final outcome of a scheduled January 5, 2026 compliance review has not been established in the available reporting.
What happened during Osment’s arrest?
Osment was arrested on April 8, 2025, at Mammoth Mountain ski resort in Mammoth Lakes, California. The Associated Press reported that he was arrested on suspicion of public intoxication. He was 37 at the time, according to the AP. Associated Press coverage
Reports published April 17 and 18 described body-camera footage in which Osment shouted that he was being attacked or kidnapped, called an officer a Nazi, and used an antisemitic slur. The slur is not repeated here. Those accounts describe what was reportedly heard in the footage; they should be distinguished from the formal charges filed in the case. What did Osment say in his apology?
On April 17, Osment said, “I’m absolutely horrified by my behavior.” He attributed his conduct to having been “in the throes of a blackout,” according to Us Weekly’s account of his statement. Us Weekly

He also addressed the impact of his words on Jewish people. The Los Angeles Times reported that he said, “I’ve let the Jewish community down and it devastates me,” and added, “I don’t ask for anyone’s forgiveness, but I promise to atone for my terrible mistake.” Los Angeles Times
What charges did he face?
Prosecutors charged Osment with misdemeanor public intoxication and cocaine possession, the Associated Press reported. Coverage also describes the second charge as possession of a controlled substance. The arrest was initially reported as being on suspicion of public intoxication; the later charges are a separate stage of the case. Associated Press

What did the judge order, and was the case dismissed?
In June 2025, a judge approved diversion over the objection of Mono County District Attorney David Anderson. Under the terms reported by the Los Angeles Times, Osment was required to attend three Alcoholics Anonymous meetings per week and therapy at least twice a week for six months. Failure to meet the conditions could revive the criminal proceedings. Los Angeles Times coverage of the diversion decision
The case was not confirmed as dismissed in the available reporting. A compliance review was scheduled for January 5, 2026, but the final result of that review has not been established here. Diversion requirements and a scheduled review do not, by themselves, establish that the charges were dismissed.

Why is the story receiving attention?
Osment is widely known for playing the child in The Sixth Sense and for starring in A.I. Artificial Intelligence, as noted by the Associated Press. The case has drawn attention not only because of his public profile, but because reports of the arrest footage, his apology, the criminal charges, and the later diversion decision are distinct parts of the story.
