Ashley Biden was the reported owner of a diary at the center of a federal stolen-property investigation—not someone publicly shown to have committed wrongdoing. The public record documents guilty pleas involving the transportation of stolen belongings, a search of Project Veritas founder James O’Keefe’s residence, and later litigation over seized materials. It does not establish the truth of alleged diary passages, and the FBI did not confirm them.
Was Ashley Biden’s diary stolen?
The public court record describes a federal investigation into a diary reported stolen from Ashley Biden. In a December 7, 2021 opinion, Magistrate Judge Sarah L. Cave wrote that a court had found probable cause to believe James O’Keefe’s residence contained evidence of federal crimes, including conspiracies involving the interstate transportation of stolen property and possession of stolen goods. The warrant was issued on November 5, 2021, and the FBI searched O’Keefe’s residence the next day, seizing phones.
Probable cause to search is not a finding that the person searched committed a crime. Nor does the warrant establish what the diary said. It authorized a search for evidence connected to suspected offenses.
What did the people who sold the belongings plead guilty to?
On August 25, 2022, Aimee Harris and Robert Kurlander pleaded guilty to conspiracy to commit interstate transportation of stolen property. The Justice Department said the conspiracy involved personal belongings belonging to an immediate family member of a then-former government official who was a candidate for national office. DOJ did not name the property owner in its announcement; reporting identified her as Ashley Biden.

DOJ said a New York organization paid $40,000 for the diary and other personal belongings. That is the amount reported for the items together, not a stated price for the diary alone. The pleas concerned a stolen-property conspiracy; they were not pleas about the truth of anything allegedly written in the diary.
Did the FBI confirm the alleged diary contents?
No. The FBI’s public announcement and the charging documents did not confirm alleged diary contents. PolitiFact made that distinction explicit in September 2022. The criminal case described the movement and sale of property; it did not authenticate attributed passages or establish that allegations about the diary were true.

That distinction matters because evidence that an item was stolen or transported does not, by itself, prove the accuracy of claims later attributed to it. The public criminal record cited here does not verify those claims.
Why did the FBI search James O’Keefe’s residence?
The search was part of an investigation into suspected federal offenses connected to the diary reported stolen from Ashley Biden. Judge Cave’s opinion says the warrant followed an affidavit from a federal law-enforcement officer and a probable-cause finding. The FBI executed it on November 6, 2021, and seized phones.

On December 7, 2021, the court denied a media request to access warrant materials, reasoning that unsealing any portion would compromise the investigation’s integrity and third-party privacy. The underlying warrant application and affidavit were not made public by that ruling, so the opinion does not disclose the full evidentiary basis for the search.
What happened in Project Veritas’s court fight over the seized materials?
Project Veritas argued that the First Amendment protected its access to materials seized in the investigation. In December 2023, a federal judge rejected that argument. The Associated Press reported that the dispute involved more than 900 documents.

That decision addressed access to seized materials, not whether alleged diary passages were genuine or true. A separate account appeared in a January 2024 Justice Department interim report: DOJ summarized a proffer by Project Veritas counsel that the organization decided not to publish the diary and delivered it and other belongings to local law enforcement. That is an account relayed in the report, not a complete, adjudicated finding about every step in the items’ chain of custody.

Axios reported on April 9, 2024, that Harris received one month in prison, three months of home confinement, and three years of probation, and was ordered to repay proceeds. In the same report, Axios said Kurlander had not yet been sentenced. That describes his status as reported on that date; it does not establish his status today.

The key distinction throughout is between the documented stolen-property case and unverified claims about private diary content. The former is reflected in court proceedings and guilty pleas; the latter was not confirmed by the FBI or established by the cited public record.
