Andrew and Tristan Tate: UK Arrest Warrant, US Detention and Extradition Status

Andrew and Tristan Tate were arrested in Miami on 18 July 2026 after British authorities brought additional charges. By the latest dated report available here, 17 September 2026, UK prosecutors had formally requested their extradition from the United States. A Miami federal judge had denied their request for release pending the extradition process. The brothers deny wrongdoing; the charges are allegations, not findings of guilt.

What happened to Andrew and Tristan Tate?

The brothers’ detention followed a British arrest warrant and the addition of charges in a UK investigation. Hertfordshire Constabulary said they were arrested in Miami on 18 July 2026 and remained detained as legal proceedings continued. On 19 July, the force announced that 38 additional charges had been authorised, bringing the reported UK total to 59: 42 against Andrew Tate and 17 against Tristan Tate. Hertfordshire Constabulary’s statement sets out the arrest and the charge counts.

The reported allegations include rape, assault, trafficking for sexual exploitation, and offences involving indecent images of a child and extreme pornography. The BBC reported that the additional charges concern alleged actions between 2010 and 2017. These are allegations brought by authorities; they do not establish that the alleged conduct occurred. Are the Tate brothers still in custody?

The latest dated custody ruling in the reporting cited here is from 9 September 2026. A federal judge in Miami denied the brothers’ request for release while the extradition process continued. The Associated Press described the process as potentially months long. This ruling establishes their custody status as reported on that date; it does not confirm their status after the report. Has the UK formally requested extradition?

Yes. On 17 September 2026, the BBC reported that UK prosecutors had formally filed extradition requests and that the US State Department had received them the previous week. The BBC said the request would go through State Department review, followed by further steps involving the US Justice Department and courts. The reporting available here does not establish a final decision on extradition or a later court date. The BBC’s account of the request describes the reported process.

How the UK case reached this stage

  1. 2024: Reuters reported that a British judge issued an arrest warrant. It also reported that, by 9 September 2026, the brothers had not appeared in a British court to enter pleas to the charges.
  2. 18 July 2026: Andrew and Tristan Tate were arrested in Miami following the UK request and announcement of new charges. Hertfordshire Constabulary said they remained detained pending legal proceedings.
  3. 19 July 2026: Hertfordshire Constabulary announced 38 additional authorised charges, taking the reported total to 59: 42 against Andrew Tate and 17 against Tristan Tate.
  4. 9 September 2026: A Miami federal judge denied their request for release while extradition proceedings continued.
  5. 17 September 2026: The BBC reported that UK prosecutors had formally requested extradition and that the US State Department had received the requests the previous week.

How this differs from the Romanian proceedings

The UK extradition request is a separate legal track from criminal proceedings the brothers have faced in Romania.
