Prosecutors filed an appeal notice later that year, then withdrew it on December 23, 2024. The dismissal remains in place; Baldwin was not acquitted by a jury.
Why was the Rust case dismissed?
The case arose from the fatal shooting of cinematographer Halyna Hutchins on October 21, 2021, on the New Mexico set of Rust. During Baldwin’s trial, the defense raised a dispute over ammunition delivered to the Santa Fe County Sheriff’s Department that had not been disclosed to the defense before trial.

On July 12, 2024, Judge Mary Marlowe Sommer found the ammunition material and potentially exculpatory. She also found that its disclosure on the third day of trial negatively affected the defense’s preparation. She dismissed the case with prejudice.
What the State disputed
In its December 23, 2024 withdrawal filing, the prosecution argued that the ammunition was not material to its case against Baldwin and that the defense knew about it before trial. Those are the State’s contentions, not the judge’s findings. The dismissal was based on the court’s assessment of the disclosure and its impact.

The First Judicial District Attorney’s notice said the decision to withdraw followed consultation with Hutchins’s family. Morrissey described the prosecution’s view in that notice, saying: “This has always been about seeking justice for Halyna Hutchins. We regret that Mr. Baldwin will not be held accountable for the role he played in the death of Halyna Hutchins and as we withdraw the appeal, we do so with the hope that the outstanding lawsuits air all the facts of her death.” That is the prosecutor’s statement, not a judicial finding.

The State’s withdrawal filing says six live rounds were found on the Rust set. It also says Troy Teske delivered 23 rounds to the Santa Fe County Sheriff’s Department on March 6, 2024, and that three of those rounds had characteristics matching live rounds found on the set. These figures come from the State’s filing; they do not independently establish where the set ammunition originated.

The same filing records both the court’s finding that the late-disclosed ammunition was material and potentially exculpatory and the prosecution’s disagreement with that conclusion. The procedural outcome is clear even though the parties disputed the evidence’s significance: the judge dismissed the case with prejudice, and the State later withdrew its appeal.

What the dismissal does—and does not—mean
- It bars refiling the same manslaughter charge. That is the effect of the dismissal with prejudice.
- It was not an acquittal. A dismissal ended the trial without a jury verdict.
- The State did not complete an appeal. It filed an appeal notice and withdrew it before an appellate court resolved the matter.
- It does not establish the status of separate civil lawsuits. The district attorney’s notice referred to outstanding civil lawsuits but did not state their later procedural status.
