You can hold a formal wedding ceremony at a home in California. The marriage still needs to meet California’s statewide requirements for a valid license, an authorized officiant, any required witness, and timely return of the completed license. Separately, check with the city or county responsible for the home about whether your planned gathering or event setup needs local approval.
What makes the marriage legally valid?
Choosing a home as the ceremony venue does not replace the state’s marriage formalities. California county guidance allows a ceremony at a location of the couple’s choice, but the couple still needs a valid marriage license and an authorized person to solemnize the marriage. The general rule is that the couple, officiant, and any required witness are physically present together for the ceremony. Get the license from a county clerk
Contact the county clerk for current application steps, fees, and appointment availability; fees and issuance hours vary by county. Both parties generally appear in person with valid photo identification. Plan the ceremony within 90 days of the license’s issue date, because that is the license’s validity period.
Choose an authorized officiant
California’s relevant officiant rules are in Family Code sections 400–402. The state says officiant credentials generally do not need to be filed with a clerk or another office, but you should confirm that the person you choose is legally authorized and will complete the license accurately. If the officiant is clergy, the state’s August 5, 2025 letter says the license entry must identify the religious denomination and include the official title. An unclear entry can lead to county or state verification before registration. See the CDPH letter to county clerks and recorders.
Public or confidential license: which should you choose?
California offers public and confidential marriage licenses, and the witness rules differ. Confirm current eligibility and application details with the county that will issue your license rather than assuming one option fits every couple.

The California Department of Public Health explains the distinction. Ask the issuing county which witness rule applies to your license before arranging the ceremony.
Can the home host the event without local approval?
State marriage rules do not establish whether a particular residence can host a gathering of a particular size or setup without local approvals. Before fixing the guest count or arranging equipment, contact the city or county responsible for the address and ask about rules that may apply to your plan, including land use, event permits, fire and occupancy conditions, noise, parking, and neighborhood or property restrictions. Requirements depend on the location and details of the event.

Use this sequence to prepare
- Contact the county clerk. Confirm how to apply, current fees, and appointment availability.
- Obtain the license and schedule within its validity period. California marriage licenses are valid for 90 days from issuance.
- Confirm the officiant. Verify the person’s authority and agree on who will complete the license. For clergy, follow the state’s denomination and official-title entry guidance.
- Check the home’s local requirements. Ask the responsible city or county about the specific address, guest count, and planned event setup.
- Arrange any required witness. A public license requires at least one witness, with no more than two permitted to sign; confirm the rule for a confidential license with the issuing county.
- Make sure the license is returned. The officiant must return the completed original to the appropriate county office within 10 days after the ceremony. Contact the relevant recorder if you need certified copies; one is not automatically sent after the marriage.
