Artem Chigvintsev, the professional dancer associated with Dancing with the Stars, was arrested in Napa County on August 29, 2024, on suspicion of felony domestic violence. On September 24, the Napa County District Attorney’s Office announced it would not file criminal charges after reviewing the investigation and evidence. The arrest was an allegation, not a conviction.
Why was Artem Chigvintsev arrested?
According to CBS San Francisco’s report based on county booking records, Chigvintsev was booked under California Penal Code 273.5(a). The code concerns willfully inflicting corporal injury resulting in a traumatic condition on a spouse, partner, or cohabiting family member. He was released the same day after posting $25,000 bail. That describes the booking allegation, not a proven account of what happened. An arrest on suspicion does not establish guilt, and Chigvintsev was not convicted in this matter.
Was Chigvintsev charged?
No. On September 24, 2024, Napa County District Attorney Allison Haley announced that her office had reviewed the criminal investigation and evidence presented and declined to file criminal charges. The DA’s office explained that prosecutors have an ethical obligation to file charges only when evidence can support proof beyond a reasonable doubt, the standard required for a criminal conviction. The distinction matters: the DA did not dismiss charges that had already been filed; the office said it would not file them. Nor does the decision amount to a factual finding about what occurred. It means the prosecutor concluded the available evidence did not meet the standard needed to bring charges ethically.
Who was the alleged victim?
Authorities did not publicly identify the alleged victim. The DA’s release specifically said it would not provide further case information, including that person’s identity. Contemporary reporting likewise noted that officials had not identified the person publicly. It is therefore not appropriate to state an identity as fact. Could the DA revisit the decision?
The DA’s office said it could revisit the matter within the applicable statute of limitations if it learned of other incidents or previously unknown facts or evidence. That statement describes a possibility; it does not establish that the office later reopened the case or filed charges.

The criminal charging decision is separate from the couple’s family-court proceedings. The Los Angeles Times reported that Nikki Garcia filed for divorce on September 11, 2024. In February 2025, ABC News reported that a representative said the couple had settled the divorce and that both parties dropped domestic violence restraining orders against each other as they sought to move on and co-parent.
