Seth Green’s Bored Ape NFT, BAYC #8398, was reported stolen in a phishing incident just days before it was due to make its “world debut” as a character in a planned TV project. Green called the ape Fred. The token was later reported returned, but coverage of a 2022 launch plan does not establish that White Horse Tavern was ultimately released.
What was stolen—and what was Fred?
In May 2022, actor and producer Seth Green said he had been phished and that four NFTs were taken: Bored Ape Yacht Club #8398, two Mutant Apes and a Doodle. Green had named the Bored Ape Fred. This was a theft of digital tokens and control associated with them—not the theft of a physical ape or the erasure of an image file.
Futurism reported Green’s account and quoted a post in which he said he had been phished and had four NFTs stolen. Contemporaneous coverage also described the Bored Ape as a character Green had been developing for a television project. Futurism’s account and BuzzFeed News coverage document the incident as reported at the time.
Why did the theft matter to the planned show?
Green had been developing White Horse Tavern, with Fred intended to star. At VeeCon in May 2022, Green described having spent months developing the ape’s intellectual-property potential for the show and said the theft came days before its planned debut. That made control of the token more than a collectible issue: Green’s project depended on his ability to use the character under the applicable BAYC terms.

The phrase “supposed to star in a new TV show” refers to that announced plan. In August 2022, The Block reported that the ape had been returned and Green was launching the project. The reporting available here does not verify whether the series was later completed, released or canceled. The Block’s August 2022 report describes the return and launch plan, not a confirmed final release.
What rights did a Bored Ape owner have?
Yuga Labs’ BAYC license says that, subject to continued compliance with its terms, it grants the owner of a purchased Bored Ape artwork an unlimited, worldwide license to use, copy and display the art to create derivative works. The same terms say that the license does not convey Yuga’s other trademarks or intellectual-property rights. Yuga Labs’ license terms are the relevant starting point for understanding why a change in token control could matter to Green’s plans.

That language should not be reduced to “the thief owned the copyright.” It describes a license, not a blanket transfer of every right associated with Yuga Labs or a ruling about who could lawfully use Fred after the reported theft. The terms page alone does not settle their application to a theft or a downstream sale.
An excerpt from a 2022 SEC filing described the then-current BAYC terms as royalty-free and worldwide, and discussed fake websites used in NFT phishing campaigns, including targeting collectors such as Green. That is context about the license and phishing environment; it is not an SEC finding on the merits of Green’s particular dispute. Was the ape returned?
Yes. Later 2022 coverage reported that Fred had been returned to Green after the reported theft and subsequent ownership by a pseudonymous collector identified as DarkWing83. The Block also reported that Green was moving forward with the project. Those reports support the return and the 2022 launch plan; they do not establish the show’s eventual release status.
