Alec Baldwin’s criminal prosecution over the fatal 2021 Rust set shooting ended on December 23, 2024, when New Mexico Special Prosecutor Kari Morrissey withdrew the state’s appeal of a judge’s dismissal of the involuntary manslaughter charge. The case ended through court procedure—not a jury verdict or acquittal.
What happened in Baldwin’s criminal case
Baldwin was charged with involuntary manslaughter after cinematographer Halyna Hutchins was fatally shot during a rehearsal for Rust outside Santa Fe in October 2021.

In July 2024, Judge Mary Marlowe Sommer dismissed the charge midway through Baldwin’s trial. The Associated Press reported that the dismissal followed a dispute over police and prosecutors withholding evidence from the defense. The state filed a notice of appeal on November 21, 2024. Morrissey withdrew that appeal on December 23, according to the First Judicial District Attorney.
Why the appeal was withdrawn
The prosecutor’s office said multiple barriers had impeded further litigation. The Associated Press also reported that New Mexico’s attorney general would have handled further appellate proceedings and did not intend to pursue them exhaustively. Those were explanations attributed to the officials and reporting; the withdrawal itself is the decisive procedural event.

Was Baldwin acquitted?
No jury returned a verdict. The trial judge dismissed the case before it reached that point, and the state later withdrew its appeal of the dismissal. So the accurate description is that Baldwin’s criminal prosecution ended after dismissal and appeal withdrawal—not that a jury found him not guilty.

The end of Baldwin’s criminal prosecution is separate from civil litigation connected to the shooting. The Los Angeles Times reported that Hutchins’s family reached a settlement involving Baldwin and other producers in 2022; that wrongful-death matter was not the criminal appeal.

Baldwin also brought a separate civil lawsuit against New Mexico officials. The Associated Press reported on July 30, 2025, that the suit had been dismissed without prejudice, leaving the possibility of a motion to reinstate. That report does not establish the lawsuit’s status after that date.
