Emilie Kiser, who filed as Emilie Henrichsen, sued to restrict public access to records concerning her son Trigg’s death. The court did not keep every record private: on August 7, 2025, it ordered a 55-page Chandler police report released with additional redactions to passages describing a video of the child’s final moments. A later partial release of the medical examiner’s report was reported in August 2026, while other related records were still under court restriction as of August 26, 2026.
Why did Emilie Kiser sue over the records?
Henrichsen v. City of Chandler, et al., was filed in Maricopa County Superior Court on May 27, 2025. The case number is CV2025-018383. It concerned public access to investigative and post-mortem records related to Trigg’s death, not a criminal prosecution of Kiser. The court’s minute entry and a LegalClarity case summary document the case and its background.
The case summary describes the requested categories as police reports, 911 calls, scene photographs, body-camera footage, surveillance footage and autopsy records. That list is a secondary-source summary, not a verified exhaustive inventory of the complaint. The dispute arose amid substantial public interest: LegalClarity reported that more than 100 public-records requests had been submitted by the time the suit was filed.
What did the judge order released?
Phoenix Newspapers, Inc., which intervened in the case, sought release of a redacted Chandler Police Department report. On August 7, 2025, Judge Christopher Whitten granted that request in part and denied it in part. The court ordered the 55-page report released with further redactions to passages describing a video of Trigg’s final moments. The official minute entry was filed August 8, 2025. The ruling drew a line between information that could help the public examine the investigation and the narrow passages at issue. The court said that most of the report could be released and that the disputed transcript sections were “not necessary for public accountability.” It also left prior orders covering other material under review or dispute unchanged.
What was the court balancing?
The judge described the case as involving “two strong but competing interests: the strong right the public has in examining government records under Arizona’s Public Records Law, and the profound privacy rights of a grieving mother.” The decision treated the police report and the graphic passages about the video differently: it allowed access to the report while permitting those passages to remain redacted.

That was a case-specific balance, not a blanket ruling that death-related records are automatically private. The Maricopa County Clerk’s records-access guidance says court records are generally open unless closed by law or court rule.
What is known about the medical examiner’s report?
In a report published August 27, 2026, The Arizona Republic said the first page of the medical examiner’s report was released on August 25. The newspaper reported that the stated cause of death was brain injury due to drowning and the manner of death was accident. The Republic also reported that the medical examiner completed the report on May 21, 2025. These details are attributed to the newspaper’s account; the full underlying report is not available here. Are the records still sealed?
Not all of them, based on the latest located reporting. The Chandler police report was ordered released with additional redactions in 2025, and the first page of the medical examiner’s report was reported released in August 2026. The Arizona Republic said other related records remained sealed by court order as of August 26, 2026.
The status of each remaining category—including 911 recordings, photographs, footage and the rest of the medical examiner’s materials—is not established by that update. Nor does it establish whether any orders changed after August 26, 2026. The court’s 2025 order expressly did not alter earlier restrictions on other disputed materials.
