Why Judge Alsup Warned Anthropic’s $1.5 Billion Authors’ Settlement Could Be Forced “Down the Throat” of Authors

Judge William Alsup’s “down the throat of authors” warning concerned unresolved terms in an earlier proposal. The $1.5 billion Anthropic settlement received final approval in July 2026.

The “down the throat of authors” warning describes an earlier stage of Bartz v. Anthropic PBC, not the case’s current outcome. On September 8, 2025, Judge William Alsup declined to preliminarily approve the proposed $1.5 billion settlement, questioning whether key terms had been settled and whether authors had enough control. On July 20, 2026, a different judge, Araceli Martínez-Olguín, granted final approval and entered judgment.

What did the judge mean by “down the throat of authors”?

At a September 8, 2025 hearing, Alsup said he was worried that publishers might work out a deal among themselves and “force down the throat of authors” a payment share that conflicted with authors’ own agreements. The phrase reflected his concern about how the proposed settlement was being developed and administered; it was not a finding that the final settlement was invalid.

At that point, important details remained unresolved, according to Ars Technica’s December 2025 account of the hearing and court proceedings. They included which books and authors were covered, how claims and notice would work, how money would be allocated, how disputes would be resolved, and how to handle books with multiple rights holders. Alsup declined preliminary approval then.

What was the Anthropic case about?

Authors sued Anthropic over its acquisition and use of books in connection with AI models. The court’s underlying rulings drew a distinction between training and acquiring the books: it found training on the books to be fair use, while finding infringement in Anthropic’s acquisition and retention of millions of pirated books. The settlement should not be read as a blanket ruling that training AI on copyrighted works is unlawful.

Did the judge reject the settlement?

Alsup declined to grant preliminary approval to the proposal before him in September 2025. That was an earlier procedural decision, not the final disposition of the case. The matter later proceeded through preliminary approval and a final approval process under Judge Martínez-Olguín after Alsup retired.

What happened to the $1.5 billion settlement?

On July 20, 2026, Martínez-Olguín granted final approval, entered judgment, and dismissed the action with prejudice. The judgment says: “The above-captioned Action is DISMISSED in its entirety with prejudice.” The court retained jurisdiction over implementation and administration, so final approval did not itself mean every administrative step was complete.

The approved settlement is reported to cover more than 482,000 books. The Associated Press reported on July 21, 2026, that authors or publishers had claimed about 91% of the covered books by that date. That is a dated snapshot, not a live claims total. The official settlement website is the appropriate place to check current class-member and administration information.

What did objectors dispute?

Before final approval, some class members objected to the proposed compensation, allocation, and attorneys’ fees. Ars Technica’s May 2026 report also described objectors’ calls for prospective protections and greater transparency about how individual works were handled, as well as complaints about the processing of objections. These were objectors’ arguments, not findings adopted by the court; the July 2026 final order establishes the current case status.

How much does an author get per book?

The $1.5 billion figure is the settlement fund, not a per-book payment. The sources cited here do not establish an individual author’s payment amount. The amount, if any, depends on the approved allocation and a person’s circumstances, so authors should consult the official settlement materials rather than assume a uniform payment for every book.
