Olmedo found his request untimely and concluded he had not shown, by clear and convincing evidence, that he was unlikely to flee, posed no danger, and had a substantial, non-delaying appeal. Her ruling concerned release after conviction while an appeal was pending; it did not decide whether the conviction would survive appeal.
What kind of bail was Masterson seeking?
This was not a request for ordinary pretrial release. Masterson had already been convicted and sentenced. He asked to remain out of custody while challenging the judgment on appeal.
California Rule of Court 8.312 allows a defendant to apply to the reviewing court for bail, reduced bail, or release on conditions after showing that relief was sought in superior court and unjustifiably denied. The rule describes the appellate procedure; the trial judge’s order applied the requirements for bail on appeal under California Penal Code section 1272.1. California Rule of Court 8.312
What did the judge require him to show?
Judge Olmedo’s order said Masterson had to establish all three statutory criteria by clear and convincing evidence:

- He was not likely to flee.
- He did not pose a danger to another person or the community.
- His appeal was not being pursued to delay the sentence and raised a substantial legal question that could result in reversal.
The judge concluded he had not made the required showing. She also found the motion untimely. These were reasons for denying release, not a decision on the underlying appeal. The reproduced January 2024 order
Why did the judge see a risk that he would flee?
The order focused on the consequences if Masterson lost his appeal and on whether proposed release terms would adequately secure his return. Olmedo wrote: “If defendant’s conviction and sentence are upheld on appeal, he will likely remain in custody for decades and perhaps the rest of his life.”

She also considered changes in his family circumstances and related financial pressures. Referring to divorce proceedings, she wrote: “In light of the fact that defendant has no wife to go home to, defendant now has every incentive to flee and little reason to return to state prison to serve out the remainder of his lengthy sentence should his appeal be unsuccessful.”
The judge noted that Masterson had appeared in court while previously free on bail exceeding $3 million. But she reasoned that his circumstances had materially changed after conviction and the imposition of a life sentence. She also cited related civil litigation and possible financial obligations, and found the defense had not shown what bail amount or conditions would adequately assure his return. What danger-related concerns did the order cite?
Olmedo pointed to the violent nature of the offenses of conviction, testimony at trial from additional alleged victims, allegations in related civil litigation, and unresolved questions about relinquishment of firearms. The civil-litigation allegations were cited as part of the judge’s assessment; they should not be treated as facts adjudicated in that civil case.
Why did the judge find the request untimely?
Masterson was remanded after the May 2023 verdict and sentenced in September 2023, but he did not request bail pending appeal until January 2024. Olmedo found that he had not explained the delay. Her order ended: “Defendant’s Motion for Bail on Appeal is DENIED as untimely and on its merits.” It also dismissed the request for bail pending a habeas petition. The reproduced January 2024 order

How does the denial fit into the case?
In May 2023, a jury convicted Masterson of two counts of rape by force or fear and did not reach a verdict on a third count. In September, Olmedo imposed two consecutive terms of 15 years to life, amounting to 30 years to life. The January 2024 bail ruling addressed whether he could be released while challenging that judgment, not whether the convictions were valid. MyNewsLA’s January 24, 2024 report
Later filings and appellate proceedings were separate from the bail decision. An Associated Press report dated November 17, 2025, described a habeas petition alleging ineffective assistance and other trial errors and said the direct appeal remained pending at that time. A June 25, 2026 report said oral argument in the direct appeal had occurred and the matter was under submission then. Those are dated procedural snapshots, not the outcome of either proceeding.
