Potentially—but there is no blanket permission to show news footage just because a stream reports on news. Section 52(1)(a)(iii) of India’s Copyright Act, 1957 recognizes fair dealing for reporting current events and current affairs. Whether a particular use qualifies depends on its purpose, the footage’s relevance, and how much is used. The law does not set a universal seconds-based safe harbour, and a legal argument does not guarantee that YouTube will leave a stream uninterrupted.
What Indian law says about reporting current events
The Copyright Office’s summary of section 52(1)(a) lists fair dealing for certain purposes, including “the reporting of current events and current affairs, including the reporting of a lecture delivered in public.” That is the statutory purpose most directly relevant to a news livestream. Depending on the facts, criticism or review may also be relevant when the footage is used to examine or critique something.
The subject of a programme is not enough on its own. Showing a clip during a stream that discusses the news does not automatically make the use fair; the use of that clip must itself be connected to a statutory purpose and fair in its circumstances. The official summary is available from the Copyright Office, Government of India, last updated 16 July 2026. The relevant statutory text is in Chapter I and Chapter VIII of the Copyright Act.
How to assess a particular clip
Indian courts assess fair dealing case by case; there is no formula that turns a clip into fair dealing merely because it is short. A 2026 Delhi High Court judgment identifies context, purpose, and the extent and length of material used as relevant considerations, and says there is no universal standard across cases. The practical question is: why is this excerpt needed for this report or commentary, and is the amount used proportionate to that purpose?

These are ways to apply the legal considerations, not a checklist that guarantees a result. In Super Cassettes Industries Ltd. v. Hamar Television Network Pvt. Ltd. (Delhi High Court, 24 May 2010), the Court considered music in news programming. It found the music in the examples before it was not relevant to the news reports and emphasized both the quantity and the qualitative importance of what had been taken. The case concerned music and television programming, not a definitive ruling on every kind of YouTube livestream footage; it is useful as a caution about relevance and the nature of what is used. Read the judgment.
The Delhi High Court’s 2026 appellate judgment likewise says fair dealing is not specifically defined in the Act and is assessed case by case. Its discussion is in FAO(OS) (COMM) 268/2022 and FAO(OS) (COMM) 303/2022, 2026:DHC:2339-DB. Neither that approach nor the statute supplies a universal number of seconds that makes a clip safe.

Why section 39 can also matter for broadcast clips
Section 52 is not the only provision to consider when the source is a television or other broadcast. Section 39 separately addresses broadcast reproduction rights and performers’ rights, including fair-dealing use of excerpts of a broadcast for reporting current events and certain other stated purposes. The Copyright Act also defines communication to the public broadly, and its definition of broadcast includes communication by wireless diffusion or wire. Those provisions may be relevant to a public livestream, but they do not by themselves decide whether a particular use infringes copyright.
There may be several rights in a clip. Do not assume the news channel owns every element or that only one right is involved. The applicable rights depend on the material and its ownership.

Fair dealing and YouTube enforcement are separate questions
A fair-dealing argument under Indian law does not establish that a platform claim or interruption will not occur. Legal merits and YouTube’s practical handling of a stream are distinct questions. The cited legal materials do not promise that a use someone considers fair will avoid platform action.
Do not rely on attribution, a disclaimer, not monetizing, or using a short clip as automatic permission. None of those factors, on its own, establishes fair dealing under the provisions discussed here. If a claim or threatened dispute concerns a specific stream, consult an Indian copyright lawyer who can assess the actual footage, rights, purpose, and circumstances.
