In early October 2023, users testing Microsoft’s new Bing Image Creator found that it could sometimes produce images of Mickey Mouse and other copyrighted characters in scenes evoking the September 11 attacks. The reported results came from Bing’s implementation of OpenAI’s DALL·E 3, shortly after Microsoft made the model broadly available.
The important detail was not a single magic prompt. Direct requests for terrorist imagery could be blocked, while indirect descriptions of aircraft, skyscrapers, explosions, and recognizable characters reportedly produced similar results. Disney had not responded to requests for comment by the time the report was published on October 6, 2023.
What happened after DALL·E 3 launched in Bing
Microsoft announced on October 3, 2023, that DALL·E 3 was available through Bing Chat and Bing Image Creator. The company described the feature as free and said it included moderation intended to block nudity, violence, hate speech, and illegal activity.
Users quickly began stress-testing those safeguards. Contemporaneous reporting by Futurism, citing testing by 404 Media’s Samantha Cole and other users, described images involving Mickey Mouse, Kirby, SpongeBob, weapons, aircraft, explosions, and skyscrapers. The results varied, and they should not be understood as one standardized image or as evidence of a real event.

“Microsoft’s AI” is shorthand here. The consumer-facing product was Bing Image Creator, operated and moderated by Microsoft, while the underlying image model was OpenAI’s DALL·E 3. Microsoft’s documentation identifies DALL·E as an OpenAI model used in Bing’s generative features.
The reported workaround was indirect wording
According to the report, explicit prompts requesting terrorism or a familiar phrase associated with the September 11 attacks could be rejected. Less direct prompts—describing a cartoon character sitting in an aircraft headed toward two skyscrapers, for example—could sometimes evade those checks.
That distinction matters because a safety system has to assess more than a short list of prohibited words. A prompt may sound innocuous in isolation while the resulting image combines several dangerous elements. Moderation therefore needs to consider:
- the wording and likely intent of the prompt;
- the image produced by the model;
- the combination of characters, weapons, aircraft, explosions, and identifiable locations; and
- the possibility that users will redistribute a realistic-looking image without context.
Microsoft’s Image Creator policy prohibited content depicting, praising, supporting, or encouraging terrorism and violent extremist activity. The reported outputs appeared inconsistent with that policy. That supports describing the incident as a moderation bypass or safety failure—not as proof that Microsoft intentionally enabled terrorist imagery.

What Disney’s “no comment” actually meant
The headline’s wording is narrower than it may appear. The original report said Disney was contacted for comment but had not responded by publication time. That is not the same as a quoted corporate position, an approval, a licensing decision, or a refusal to sue. The report also said inquiries to Nintendo and Nickelodeon went unanswered.
There is no basis in that account for saying Disney endorsed the images, accepted Microsoft’s conduct, or decided that no legal action was warranted. “No response received by October 6, 2023” is the precise description.
Why Mickey turned a safety story into a copyright story
The ability to generate a recognizable Mickey-like character raises several separate legal questions, but it does not answer them.
Output is not proof of training-data infringement
A recognizable character shows that the model or its surrounding systems learned visual and textual associations connected with that character. It does not, by itself, reveal whether the training material included unauthorized Disney files. Possible sources could include licensed material, publicly available images, user-generated content, captions, metadata, or other training data. The output alone cannot establish the source or legality of the training corpus.

Likewise, a generated image is not automatically an infringement merely because it depicts a famous fictional character. The legal analysis can depend on the particular design, the degree of similarity, the prompt, the way the image is used, and whether it is private, publicly posted, commercial, or used in advertising.
Copyright and trademark are different issues
Copyright may apply to particular artistic depictions of Mickey. Trademark and related doctrines can concern branding, source confusion, trade dress, and the association of a character with Disney. Those questions are distinct from whether a platform’s moderation system should have blocked an image.
The timing also matters. The original story appeared in October 2023, before the earliest Mickey depiction from Steamboat Willie entered the U.S. public domain on January 1, 2024. Public-domain status for one early depiction does not make every later Mickey design, Disney logo, trademark, or Disney-associated presentation freely usable. Nor does it retroactively settle the legal questions surrounding the 2023 incident.
Who was responsible for what?
The incident involved a chain rather than one undifferentiated “AI”:

- Microsoft operated the consumer product and published its content rules and safety commitments.
- OpenAI’s DALL·E 3 supplied the image-generation model.
- Safety systems from both companies could affect how prompts were interpreted, blocked, or allowed.
The available reporting does not establish which particular safety layer failed, whether the model or Bing’s filters were responsible for each output, or what training sources produced the character association. It also does not show that Microsoft trained DALL·E 3.

Microsoft had previously described Image Creator as using prompt and image blocking, while acknowledging that such systems required ongoing improvement. Its October launch announcement also highlighted content moderation and Content Credentials, including an invisible watermark aligned with the C2PA provenance specification.
These tools address different problems:
- Prompt filters attempt to stop risky requests before generation.
- Output moderation can identify harmful imagery that the wording filter misses.
- Content Credentials and watermarks can help indicate that an image was AI-generated after it exists.
A provenance marker does not prevent creation, determine who owns a character, or make a potentially unlawful use lawful. It is an identification and traceability measure, not a substitute for prevention.
Microsoft later described a broader safety approach involving content filtering, abuse detection, operational monitoring, and responsible-AI reviews. OpenAI’s DALL·E 3 announcement likewise discussed safety work around harmful visual content and misuse. The reported Bing results illustrated the gap that can exist between published safeguards and behavior under adversarial or indirect prompting.
What the episode demonstrated—and what it did not
It demonstrated
- Keyword-based blocking can miss harmful meaning expressed indirectly.
- A fictional character can be placed in a violent context even when some categories of harmful imagery are restricted.
- A product policy can prohibit content that the live system nevertheless produces.
- AI-generated images can create copyright and trademark questions without proving an answer to them.
- Watermarking and provenance do not stop generation.
It did not demonstrate
- That Disney licensed the images or approved them.
- That Microsoft or OpenAI definitely trained on unauthorized Disney material.
- That every depiction of Mickey Mouse was unlawful.
- That Disney had decided not to take legal action.
- That the same behavior remains possible in the current version of Bing Image Creator.
Dated update: why this is a historical account
This incident belongs to the first public rollout of DALL·E 3 in Bing in October 2023. Models, filters, policies, interfaces, and availability can change. The reported behavior should not be presented as a test of Bing Image Creator in 2026, and no conclusion about the current product follows from those historical reports alone.
Its lasting significance is broader: generative-image safety cannot rely only on obvious keywords, and the ability to produce a recognizable copyrighted character does not by itself settle questions about training data, infringement, or liability.
