Negative, your argument would require the element of intent to bring about the punishible result. Hence, reckless driving does not amount to “attempted manslaughter”. If that would be the case, it would be a felony not a misdemeanor, as it is typically enumerated in most state criminal codes. Thanks.
You are WRONG! While jurisdictions vary, going 20MPH or more over the speed limit is generally classified as reckless driving, which is NOT an infraction, but a Class 1 misdemeanor (like in Virginia). This offense can be punished with up to one year of jail. Thus, since it’s an ARRESTABLE OFFENSE, if the stop is good, the arresting officer may conduct a warrantless search of the car by virtue of a search incident to a lawful arrest. Do me a favor, learn the law first and then argue!

bottom line laws are just paper with muscle behind it. weed is a plant with life not a drug and any law can be pulled by politics that is why im going to law school and getting in politics and investing and bringing freedom back to america beat dem at there own game homie
SIGNS OF JESUS COMING:DAMASCUS,SYRIA-WILL BE DESTROYED(ISAIAH 17:1),WARS-IRAN’PERSIA’(EZEKIEL 38-39,PSALMS 83),EARTHQUAKES(MATT.24).RAPTURE (1THESS.4:17)-ABOUT TO HAPPEN–ONLY THE HOLY ONES WILL SEE THE KINGDOM OF GOD.REPENT!LIVE HOLY!THINK ABOUT THESE:IF JESUS(GOD) IS THE ONLY OMNIPRESENT WHO IS IN HEAVEN AND ON EARTH,ALL OTHER HOLY NAMES ARE IN HEAVEN NOT ON EARTH.THEN WHY DO YOU PRAY TO OTHER NAMES WHO WON’T BE ABLE TO HEAR YOU?(JOHN 14:26)..ONLY THE HOLY SPIRIT(GOD) CAN HEAR YOUR PRAYERS.
The facts of this video are flawed. Here the driver (D) was going 20MPH over the speed limit, which typically constitutes an arrestable offense (reckless driving). If the officer arrests D, it creates the automatic right to search the car under the search incident to a lawful arrest exception. Thus, the officer would have legal access into the car and find/seize D’s contraband, which would be admissible evidence and D could be found guilty of a drug felony–so why bother to show this video?
Although most of the officers in the vid were kinda unprofessional (especially the first guy with his jail remarks), 2 of the “victims” had commited crimes( the bus stop guy was debateable). I didn’t feel sorry for the people who had weed goin to jail, since they knew what they were doing,Bottom line is you don’t have to “survive” a police encounter if you don’t do anything illegal.
no, the real moral: if you have a dumbass friend like “Troy” (the one in the backseat), who can’t control his habit and won’t respect your vehicle by not getting high in it, leave his ass at home. Treat your car as a high-risk zone. What sort of idiot thinks a car is some sort of hidden bank vault to get high in?
indeed. When stopped and asked “do you know why I stopped you,” I always profess utter ignorance and let THEM tell ME why. Don’t give them any more ammunition than they already have. Also, I speak as one who has had his car searched, possibly illegally, by a cop late one night. The trainee rookie cop with her, who waited with me on the sidewalk, had the decency to apologize for her superior. And then the other cop had the gall to compliment me on my taste in music. Yeah, that makes it better.
FOR SPEEDING: Never admit actual speed you were going. If ticket is given, BEFORE he starts writing it, ask for it to be switched to your county seat. This is especially useful if you live in a large county and are picked up far from the counties central court house. Improves your chance of the officer not showing in court for your simple speeding ticket. You get off. There’s many more things you can do once issued a ticket to beat it as well, but that’s an another video.
It is absolutely insane how Cops and other forms of law enforcers get agitated and pissed off when you attempt to use your rights as a citizen. Those are YOUR RIGHTS as a citizen of this country whom THEY swore to protect and serve. Yes they swore to protect OUR RIGHTS yet they get pissed off when you flex them. Makes absolutely no sense.
@jpmitchell1980 it’s pretty much the only logical reason not to do weed. Maybe every situation like this could be avoided if we stopped prosecuting people for a harmless plant. I mean really, what good came of those kids getting arrested (in the first traffic stop) Were these kids dangerous? Did they pose an immediate threat to you and me? I don’t think so. They should have the right not to be harassed by cops.
Know what would have made this easier than anything they ever showed here? How about not even having the weed in the first place and staying the hell away from that garbage. Just a thought…an ounce of prevention is worth a pound of cure. I don’t do weed myself; I never developed a taste for it, never have, never will, so this is my take.
I love lawyers, especially this guy. Although I’m not talking to him directly, I feel like I’m actually talking to a friend, even though if you were to hire a lawyer, and it would cost alot of money because lawyers make alot of money, they still have this essence of just “helping people out” there are nice cops out there who just want to enforce the crime, but i don’t feel that connection with cops, alot of them seem like they are on a power trip. I wish i could thank the attorney in the video.
@SeanStephensen you might have to find it… but I’m sure Canadian police work the same way. Unfortunatly you guys don’t have a bill of rights, and have a different political system. If you have a lawyer, I would ask him about the same subjects talked about in the video, and make sure to take notes, and study them so you can be prepared.
@coolVideos231196 I wonder why the sheeple (those who blindly believe everything they are told by governments) assume that you have something to hide when refusing a search and think that it’s only criminals that do it. I say if it’s an illegal search then my rights should be protected. I’m glad I saw this so I don’t have to worry about the police. I think my mum thinks I’m a ‘terrorist’ just because I want to protect my freedom.

@swag909 You should have made a motion to suppress since the officer searched your property illegally. But then again I don’t know if the “smell” of marijuana gives them reasonable suspicion to allow them to search; the video wasn’t too clear about that so I’m guessing it varies from state to state.
@armand111 Ron Paul is actually a LIBERTARIAN, even though he belongs to the Republicrat party. His congressional voting record clearly proves that he doesn’t tow the party line. Often, he is the only one who votes NO on unconstitutional bills. That’s why many call him Dr. NO.A Ron Paul presidency may not change things as radically as a tyrant like Hitler could, but it would be a huge step in the right direction. He would have the bully pulpit, and everyone would have to listen.
IT WORKS!!! If a police officer tries to ask to have a look around (your vehicle, office, apartment, or property) you need only say ” I do not consent to seaches”. They will ask a say oh i just want to make sure you’re safe, etc, those are the tricks. Thats all, theres no nazi gestapo in america yet so know your rights and you should be fine.
